Been Hit By An Uninsured Driver? Let A Road Accident Solicitor Help
It is every motorist’s worse nightmare to be involved in a traffic accident, but being hit by an uninsured driver is even worse. And it’s obvious why: if the liable driver has no insurance, there’s no chance of claiming compensation for injury, medical costs and financial loss, is there? If you were to ask a road accident solicitor, they’d tell you otherwise.
The Motor Insurance Bureau is an organisation which allows drivers who suffer injury or vehicle damage as a result of the negligence of uninsured drivers to claim compensation. The Bureau has paid out nearly £2 billion since its inception in the year 1946 and now pays out about £200 million every year. Each and every motor insurance company contributes to the money paid out by the Motor Insurance Bureau, meaning that a significant amount of each driver’s insurance premium goes towards the pot. Because one in 20 cars on the UK’s roads is thought to be either underinsured or not insured at all, the organisation is a lifeline to many innocent drivers.
Drivers wishing to claim compensation for their injury and losses caused by an uninsured driver are advised to enlist the services of a road accident solicitor when approaching the Motor Insurance Bureau. Claims can be brought for legal fees and medical expenses as well as loss of earnings and vehicle damage. Compared to the process one undergoes to make a claim against a driver with insurance, the process with the MIB is much more complicated and the help of a road accident solicitor is necessary.
In order to make a claim through the MIB, legal action must be launched and a request submitted to the court for permission to make a clam. The request will be accepted or rejected by the court. Acceptance will only occur if MIB protocol has been followed exactly and if the case which is presented is convincing. The Bureau follows a strict set of guidelines and very rarely does it accept cases without a road accident solicitor.
If a driver and the road accident solicitor representing them is successful they do not have to wait for the Bureau to find the uninsured driver. Instead the case is considered and an appropriate amount of compensation awarded. Then the Bureau will work to track down the uninsured driver to reclaim their costs.
